Terms & Conditions
Misfit Boards operated by Arbor Artis, L.L.C.
Effective date: September 22, 2026
These Terms govern Misfitboards.com purchases and use where a binding agreement is formed under applicable law. The seller is Arbor Artis, L.L.C., operating as Misfit Boards, at 41 Watchung Plaza, Suite 92, Montclair, NJ 07042, United States. “We,” “us,” and “our” mean that company.
Orders and eligibility
You must be at least 18 and legally able to transact, or order through a parent or guardian who transacts for you. Provide accurate information and use an authorized payment method. An organizational purchaser must have authority to place the order.
An automated order receipt acknowledges submission. We accept a standard order when we confirm acceptance or dispatch it, whichever occurs first; approval of a custom quote confirms the custom specifications and agreed production terms. This acceptance process does not extend a promised shipping deadline or suspend legally required refunds.
Before acceptance, we may decline an order for a genuine stock shortage, unavailable delivery destination, inability to verify payment, a material pricing error, or a reasonable fraud concern. If we decline or cancel an order, we notify you and promptly refund any amount we cannot lawfully retain. We do not substitute another product, change the agreed price, or impose a new material condition without your agreement.
Prices payment and promotions
Prices are in US dollars. Applicable taxes and calculated shipping are shown before you place the order. Payment is processed through the methods offered at checkout. A payment or installment provider may have separate terms governing its service; those terms do not remove our obligations as the seller.
Promotions apply according to the conditions shown when offered. Changes to prices, promotions, inventory, or policies apply prospectively and do not change an accepted order without your agreement. If we discover a material error affecting an order, we explain it and offer a lawful resolution, including cancellation and an appropriate refund when required.
Handmade wood products and descriptions
Wood varies naturally in color, grain, and markings. Handmade dimensions may vary within disclosed tolerances, and screens affect perceived color. These characteristics do not excuse an unsafe or defective board, material misdescription, or failure to meet stated specifications.
If a listing identifies photographs as the exact board offered, we supply that board unless you approve a substitution. If a listing clearly uses representative photography, the delivered board may have a different natural grain pattern while meeting its stated species, dimensions, construction, and other material specifications. Our rescue-themed branding does not reduce your product, refund, or warranty rights.
Custom and personalized orders
We confirm custom specifications, price, estimated dispatch date, and any special cancellation terms in a written quote or order approval before production. Review engraving, spelling, measurements, and artwork carefully. We are responsible for producing the approved specifications; a customer’s later change of preference is different from our failure to follow those specifications.
Later changes require an agreed revised quote and timeline. You confirm permission to use supplied artwork or wording. Custom restrictions must be disclosed before purchase and preserve legal remedies. A special quote controls expressly agreed custom details; it does not silently waive an ordinary standard board’s satisfaction guarantee.
Shipping returns refunds and warranty
Our Shipping and Returns Policy, Refund Policy, and One Year Limited Warranty explain the purchase remedies we offer and are part of the order terms presented before purchase. A product-specific promise that gives you greater protection will be honored. Mandatory consumer rights take priority over inconsistent policy language.
We remain responsible for the obligations imposed on us as seller; handing a package to a carrier does not by itself eliminate your delivery rights. Return and warranty periods are distinct. Expiration of the 30-day satisfaction period does not extinguish a valid defect claim, and expiration of the one-year written warranty does not eliminate rights the law gives you for longer.
Care and intended use
Use boards for their intended cutting and food-preparation purposes on a stable surface. Follow the care instructions supplied with the product. Hand wash as directed, dry promptly, and maintain the wood with an appropriate food-contact-safe conditioner. Do not soak, place in a dishwasher, or expose to excessive heat. Handle a heavy board carefully and stop using a board if a condition could make use unsafe.
Damage actually caused by misuse or failure to follow reasonable care instructions may fall outside voluntary coverage. Routine care with suitable products does not require buying our brand. A care issue or third-party repair does not void coverage for an unrelated defect. Nothing here shifts responsibility for an unsafe or defective product to the customer.
Gift cards and additional goods
Purchased Misfit Boards gift cards do not expire or incur inactivity fees. Cash redemption is available where law requires, including applicable small-balance rules. Keep card details secure and contact us about loss or misuse. Promotional credits have their separately disclosed lawful terms.
Additional merchandise is subject to its pre-purchase description and disclosed return terms. A manufacturer’s separate warranty does not eliminate legal obligations that apply to us as the seller.
Website accounts and acceptable use
Keep account access secure and contact us if you believe it has been compromised. Do not use the site to commit fraud, infringe rights, distribute malicious software, access another person’s account without permission, or disrupt the service. We may restrict the offending activity when reasonably necessary. A restriction does not cancel a refund, warranty obligation, or privacy right we owe.
Our branding, original photographs, artwork, text, and other protected site materials belong to us or their respective owners. You may use the site to shop and retain information for your personal records. Other use of protected materials requires permission or a legal exception. These terms do not restrict truthful reviews, fair use, or lawful consumer complaints.
Customer reviews and supplied content
You retain ownership of submitted content. For reviews or other content deliberately submitted for public display, you give us nonexclusive, royalty-free permission to display and reasonably format it in that feature and related product pages without changing its meaning. Separate advertising use requires any additional legally required permission. Private support messages are not automatically public testimonials.
Submit only content you have the right to share, and avoid including another person’s private information without permission. We may remove unlawful, abusive, spam, or irrelevant content under reasonable moderation rules, but we do not prohibit an honest negative review or condition a refund on changing a review.
Shopify third parties and privacy
Our store is hosted by Shopify. Shopify processes information about visits and purchases to operate the store. Shopify Network Intelligence is enabled, allowing Shopify to use information about interactions with our store, other merchants, and Shopify to provide enhanced services. Information is shared with Shopify and other service providers that may process it in other countries. Details and choices are in our Privacy Policy and Shopify’s Consumer Privacy Policy.
Optional third-party services and linked sites may have their own terms and privacy notices. Read them when choosing those services. We remain responsible for our own conduct and for duties that applicable law places on us. A privacy notice explains processing; using the site is not a substitute for consent where the law requires a separate choice.
Product promises and limits on liability
We do not disclaim the express product promises we make, our written warranty, or implied warranties that apply to our goods. Website features may experience interruptions; we will use reasonable efforts to correct material errors brought to our attention. This does not excuse a misleading product description or a failure to fulfill an order.
For consumers outside New Jersey, and only when applicable law permits, our liability for ordinary contract claims is limited to the amount paid for the affected order, and we exclude consequential losses such as lost business profits. These limitations do not apply to New Jersey consumers.
For every customer, those limitations do not apply to: refunds or other remedies promised in our policies; express or implied warranty claims; personal injury or property damage; our negligence, fraud, willful misconduct, or violation of consumer-protection or privacy law; statutory damages, legal fees, or other relief that cannot be limited; or any responsibility the law prohibits us from excluding. We do not shorten a statutory period for bringing a claim. No part of these Terms requires a consumer to waive a clearly established legal right.
Resolving concerns and governing law
Please contact care@misfitboards.com so we can try to resolve a concern. Contacting us first is encouraged, not a condition on a legal remedy or deadline. These Terms use New Jersey law except where federal law or mandatory protections of your home state require otherwise. They do not require arbitration or waive jury-trial, class-action, small-claims, chargeback, or government-complaint rights.
A dispute may be brought in a court with lawful jurisdiction, including a consumer’s home-state court where the law permits. For New Jersey consumers, all rights under the New Jersey Consumer Fraud Act and the Truth-in-Consumer Contract, Warranty and Notice Act remain intact; the liability cap and consequential-loss exclusion above do not apply.
Updates and contact
Updates posted with a new effective date apply prospectively and do not reduce existing purchase rights. We provide additional notice or obtain agreement when required. Unenforceability of one provision leaves lawful provisions intact. Goodwill help neither reduces existing rights nor creates unlimited future coverage.
